1.1. Welcome to www.axisdietetics.com (the “Website”). The Website provides you with an opportunity to browse information about dietetic services and to book online consultations (the “Services”). These Services may involve the use of third-party digital health platforms, including nutrition tracking tools such as Cronometer.
1.2. The Website is operated by Alexander Hardy trading as Axis Dietetics (ABN: 52741716006), of 46 Lake Street, Forster, New South Wales, 2428, Australia, phone 0422236216 (“Axis Dietetics,” “we,” “us” or “our”). Access to and use of the Website and Services is subject to these Terms.
1.3. Please read these terms and conditions (the “Terms”) carefully. By using, browsing, and/or reading the Website, you signify that you have read, understood, and agree to be bound by these Terms. If you do not agree with the Terms, you must cease use of the Website and Services immediately.
1.4. Axis Dietetics may review and change these Terms at its sole discretion. Any updates take effect immediately upon publication on the Website. Significant changes will be communicated via the Website or by email where appropriate.
2. Acceptance of the Terms
2.1. You accept the Terms by remaining on the Website or by making a booking for Services through the Website. You may also accept the Terms by clicking to accept or agree where this option is made available in the Website’s user interface.
3. Bookings and Cancellations for Services
3.1. Bookings for Services are made via the online booking system provided on the Axis Dietetics website (“Booking System”).
3.2. If you create an account with the Booking System (currently Practice Better), you agree to the terms, privacy policy, and other legal documentation provided by the Booking System.
3.3. Certain Services may include access to Cronometer Gold, a premium nutrition tracking platform. If your program includes this feature, you agree to Cronometer’s own terms of use and privacy policy, which govern your use of that platform. Axis Dietetics provides access for the duration of your active program but is not responsible for the operation, data handling, or technical performance of Cronometer.
3.4. Payment for Services is required in advance at the time of booking via the payment methods available in the Booking System, unless otherwise agreed in writing for payment plans.
3.5. All bookings for Services are subject to Axis Dietetics’ Nutrition Services Terms and Conditions, which set out detailed policies regarding cancellations, rescheduling, fees, refunds, and program timelines. You can review these Terms during the booking process or request a copy at any time.
3.6. In summary:
Clients may cancel or reschedule appointments online through the Booking System up to twenty-four (24) hours before the scheduled time.
Within 24 hours of a scheduled appointment, cancellations or rescheduling cannot be completed online and must be requested via email.
Late cancellations, rescheduling requests, or no-shows may incur fees, including a $50 cancellation fee or forfeiture of the session fee, at Axis Dietetics’ discretion.
3.7. Axis Dietetics reserves the right to retain the full program fee in the case of repeated cancellations or no-shows. Further details, including refund eligibility and administrative costs that may apply to cancellations, are outlined in the Nutrition Services Terms and Conditions.
4. Digital Products, Free Resources, and Online Courses
4.1. Axis Dietetics may from time to time offer free digital resources, such as meal plans, guides, recipes, checklists, or quizzes (“Free Resources”) via the Website.
4.2. Free Resources are for general informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment.
4.3. All intellectual property in Free Resources remains the property of Axis Dietetics. You may not reproduce, distribute, or commercially exploit any Free Resources without prior written permission.
4.4. Axis Dietetics may require you to provide personal information, such as your name and email address, to access Free Resources. Such information will be collected and managed in accordance with our Privacy Policy.
4.5. Axis Dietetics does not currently offer digital products, ebooks, or online courses for purchase via the Website. In future, any purchases of digital products or online courses will be subject to additional terms published on the Website.
4.6. Purchase of an online course would grant you access through an online platform (“Membership Portal”). You would receive a limited, revocable, non-exclusive, non-sub-licensable, non-transferable licence for personal, non-commercial use only. Sharing of login details or course materials outside your household or business is strictly prohibited. Access rights may be time-limited, and details will be provided at the time of purchase.
4.7. Delivery details and support policies for digital products and online courses will be published on the Website if these products are offered in the future.
5. Warranty
5.1. Axis Dietetics’ Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a refund or other remedies for major failures, or to compensation for reasonably foreseeable loss or damage. You are also entitled to have services remedied if they are not of acceptable quality and the failure does not amount to a major failure.
5.2. Axis Dietetics makes no warranty that Services will meet your individual requirements or that all clients will achieve the same results.
6. Services Disclaimer
6.1. Axis Dietetics provides services from an Accredited Practising Dietitian. However, the Services do not replace medical treatment or advice from your doctor or other health professionals. See Section 8 regarding information provided via the Website.
6.2. No guarantees are made regarding specific health outcomes, weight loss, fertility results, or other clinical results.
6.3. You remain solely responsible for your physical, mental, and emotional wellbeing, decisions, and actions arising from your participation in Services.
6.4. You release Axis Dietetics from any liability arising out of or in connection with the Services except as required under the Australian Consumer Law.
6.5. Axis Dietetics may provide access to third-party applications such as Cronometer for the purpose of dietary tracking. While we recommend these tools as part of your nutrition support, we are not responsible for their performance, data accuracy, or any limitations associated with their use.
7. Website Information Disclaimer
7.1. The information, content, and materials provided on the Website, including text, graphics, images, blog posts, social media content, recipes, videos, designs, documents, logos, and other materials (“Content”), are for general informational and educational purposes only. 7.2. Use of the Website does not create a dietitian–client relationship between you and Axis Dietetics.
